Presenter(s): Family Consultants and a Justice of the Family Court

For many psychologists working in both the public and private domains, the role of the Family and Federal Court is shrouded in mystery. Most of these psychologists are dependent upon information from their clients about the Court process and have very little awareness of how the Court determines parenting matters. Many psychologists are fearful of having their notes subpoenaed, being asked for a treatment report by a solicitor or being required for cross-examination.  This presentation aims to demystify the Court process by explanation of the Family Court and the Federal Circuit Court process, explain the role of the Family Consultants and the nature of our work and to examine how information from psychologists working in the public and private systems is of significant value to the Court.

A Justice of the Family Court, Justice Cleary will be presenting on forensic reports from psychologists (Chapter 15 Expert Reports and Family Reports), treatment reports from treating psychologists and those reports from psychologists that fall in between a treatment and forensic report. Justice Cleary will discuss the limitations of the latter reports and how professionals who write these reports which are neither treatment or forensic have limited value to the Court.  Justice Cleary will also discuss the benefits of a treatment report to the Court.

The structure of the presentation will be a one hour presentation by Family Consultants and a Justice of the Family Court. It is anticipated that the active part of the presentation will go for around 50 minutes with 15 minutes left for questions. Following this there will be 20 minutes of networking where psychologists can approach the Family Consultants with general or specific enquiries.
